Roundtable Discussion: Cyber Regulation and Data Protection
The Takshashila Institution, in collaboration with Observer Research Foundation and the Ministry of Electronics and Information Technology, is convening a roundtable discussion on 6 September 2017. The discussion is convened to identify policy priorities for India in cyber regulation and help frame India’s approach to Data Protection before the rest of the world.
The event will be chaired by Rahul Matthan, Takshashila Fellow and Partner, Trilegal and Samir Saran, Vice President, ORF.
India is currently undergoing an upheaval in its approach to rights online, economic activities over cyberspace and the nature of the internet itself. These three concurrent developments in India’s legislative, judicial and regulatory approach highlight the urgency of the need for a coherent vision when it comes to cyberspace regulation.
First, the Supreme Court’s nine judge bench ruling upholding privacy as a fundamental right will significantly re-evaluate the relationship between the State, citizens and data collectors. Second, the government's appointment of a ten-member committee to identify key data protection issues will revamp the means of data collection, use and storage. And finally, TRAI’s expansion of its regulatory remit over the past few years can impact how the internet is regulated and kept open.
With the Indian government hosting the Global Conference on Cyberspace in November this year, India's approach to online rights will assume center stage and will form a crucial part of the discourse during the conference. The GCCS is the largest cyber conference in the world with over 100 governments coming together biannually to discuss issues ranging from access and innovation to security in cyberspace. The conference represents a unique opportunity for India to take leadership in incubating conversations around cyber norms and leading their adoption.
